PickWho is a free sports prediction game where users make picks on sporting events for entertainment purposes. Users compete for prizes without risking any money. No purchase or payment is required to participate.

3. Eligibility

You must be at least 18 years of age to use PickWho. By using the app, you represent and warrant that you meet this age requirement.

Geographic Restrictions: PickWho is available to legal residents of the United States and Canada, except for the following regions where contests are void and participation is prohibited:

• United States: Arizona, Iowa, Louisiana, and Montana
• Canada: Quebec

It is your responsibility to ensure you are legally permitted to use the service and participate in contests in your jurisdiction. By using PickWho, you represent that you are not a resident of any restricted region listed above.

4. User Accounts

To use PickWho, you may be required to create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

5. Use of Service

You agree to use PickWho only for lawful purposes. You agree not to:

• Create multiple accounts to gain unfair advantages
• Use automated tools or bots to make picks
• Attempt to manipulate contest results
• Harass other users or engage in abusive behavior
• Post hate speech, slurs, threats, or sexually explicit content in the community chat
• Circumvent or attempt to bypass content filters or moderation systems
• Impersonate other users or misrepresent your identity
• Attempt to gain unauthorized access to our systems

6. Prizes and Rewards

PickWho may offer prizes to top performers in weekly contests. Prize eligibility, amounts, and distribution methods are determined solely by Soni Digital LLC and may change at any time.

Taxes: Winners are solely responsible for any applicable federal, state, provincial, or local taxes on prizes. For U.S. residents, prizes may be subject to IRS reporting requirements. For Canadian residents, prizes may be subject to applicable Canadian federal and provincial taxes. We recommend consulting with a tax professional regarding your tax obligations.

7. No Gambling

PickWho is not a gambling service. Users never deposit money, wager money, or risk any financial loss. All participation is completely free. PickWho is designed to provide entertainment without financial risk.

8. Community Chat and Content Moderation

PickWho includes a community chat feature. By using the chat, you agree to the following:

• Content Filtering: Messages are automatically screened. Profanity is censored, and hate speech, slurs, and threats are blocked outright and will not be sent.
• Reporting: Users can report inappropriate messages. Messages that receive multiple reports are automatically hidden from the community. All reports are reviewed by our moderation team within 24 hours.
• Blocking: You can block any user, which immediately hides all of their messages from your view and notifies our moderation team. You can unblock users at any time from Settings.
• Message Deletion: You can delete your own messages at any time.
• Moderation Actions: We reserve the right to hide or remove any content and to mute or permanently ban users who violate these terms or our community standards. Violations may result in account suspension or termination.
• No Expectation of Privacy: Chat messages are visible to all users and app administrators. Do not share personal or sensitive information in the chat.

You are solely responsible for the content you post in the community chat. Soni Digital LLC is not liable for user-generated content but is committed to maintaining a safe and respectful community.

9. Disclaimers

PickWho is provided for entertainment purposes only. We make no guarantees about the accuracy of sports data, game results, or contest outcomes. The service is provided "as is" without warranties of any kind.

All sports predictions and decisions are made at your own discretion. Soni Digital LLC is not responsible for any decisions you make based on information from the app.

10. Limitation of Liability

To the maximum extent permitted by law, Soni Digital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use PickWho.

11. Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our sole discretion. You may delete your account at any time through the app settings.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes through the app or via email. Your continued use of PickWho after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of PickWho shall be resolved in the courts of Texas, and you consent to the jurisdiction of such courts.
